Failure to Diagnose Cancer
In a medical malpractice case, our client presented to the emergency room with shortness of breath. A chest x-ray was done, which was read the next day by the radiologist as showing a suspicious lesion. The report was not communicated to the patient. Two years later, the client was diagnosed with lung cancer, and later died. We asserted a claim that the physicians and hospital were negligent in failing to disclose the lesion, and that delay allowed our client’s cancer to metastasize. This case settled for over half a million dollars.
