Generally, a seller of defective products is only liable for punitive damages under specific conditions.

Mississippi law limits (caps) the amount of punitive damages depending on the responsible defendant’s net worth. For example, defendants with a net worth between $100 million and $500 million are subject to a $3.75 million punitive damages cap, with higher or lower caps applying to defendants depending on their net worth, subject to statutory exceptions (MS Code § 11-1-65 (2024)).

Statutory exceptions may include felony convictions or intoxication, subject to court findings.
